1. Definitions

"Platform" refers to the Podoka website and mobile application. "User" or "you" refers to any person who accesses or uses the Platform, including Beauty Specialists and Clients. "Beauty Specialist" refers to any individual or entity offering beauty services through the Platform. "Client" refers to any individual or entity seeking beauty services through the Platform.

2. Use of the Platform

You must be at least 18 years old to use the Platform. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account.

3. Services

The Platform facilitates the connection between Beauty Specialists and Clients. We do not provide beauty services ourselves. Beauty Specialists are independent contractors and are not employees, agents, or representatives of Podoka. We do not guarantee the quality, safety, or legality of the services provided by Beauty Specialists.

4. Payment

Clients will be charged for the services provided by Beauty Specialists as indicated on the Platform. Payment processing services are provided by third-party payment processors. By using these services, you agree to comply with their terms and conditions. Podoka may charge a service fee for the use of the Platform. The applicable fee will be displayed to you before you confirm a booking.

5. Cancellations and Refunds

Clients may cancel bookings in accordance with the cancellation policy displayed on the Platform at the time of booking. Refunds, if applicable, will be processed in accordance with our refund policy.

6. User Conduct

You agree not to use the Platform for any illegal or unauthorized purpose. You agree not to interfere with or disrupt the Platform or servers or networks connected to the Platform. You agree not to harass, abuse, or harm another person using the Platform.

7. Intellectual Property

All content on the Platform, including text, graphics, logos, and images, is the property of Podoka or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Podoka shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your use of or inability to use the Platform; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Platform; or (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Platform by any third party.

9. Indemnification

You agree to indemnify and hold harmless Podoka, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law principles.
